Minutes of the Extraordinary Everleigh Parish Council Meeting
held at the Collingbourne Ducis School
on Monday 16 November 2015.
Present: Cllr S Matton, Cllr K Wheeler-Mallows Cllr J Jones.
In Attendance: Mr P Gill (Parish Clerk) and two members of the public.
Election of Chairman. Cllr Matton was proposed and seconded as Chairman of the meeting and Members RESOLVED to elect Cllr Matton as Chairman of the meeting.
Apologies: Cllr D Bottomley, Cllr T Symonds and Cllr E Hudson and Cllr K Preece.
Disclosure of Interest. Cllr Hudson has previously declared a pecuniary interest in item 5.1 and is attending the meeting as member of the public. Through the Chairman, the Clerk explained that Cllr Hudson could speak during the time set aside for the public but that she would have to leave the meeting during the Council’s consideration of item 5.1.
General Public. A member of the public spoke in support of the planning application 15/10780/FUL and expanded on the reasons why the application was being made. Another member of the public spoke on the same application informing the Cllrs that they considered that the proposed constructions would contravene their property deeds and possibly those of the applicant. The Cllrs then asked both members of the public questions in order to clarify what restrictions the property deeds contained.

5.1. 15/10780/FUL – Planning application at Merle House SN8 3EY for erection of a conservatory on a front elevation of the property and to erect further 1.8m fence panel to the NW along the existing line of the fence between Leyfield House and Merle House. Having taken note of the comments made and questions asked by the public earlier in the meeting Members RESOLVED to make comment as follows: Whilst this planning application causes no issues from a planning perspective per se, the extension of the fence line between applicant’s property (Merle House) and that of the neighbouring property (Leyfield House) could cause that neighbour to be in breach of the deeds of their property. The said fence line is the responsibility of Leyfield House and the deeds state that the fence line cannot extend any further forward than the present face of the dwelling house and garage. This is why that fence stops where it does, which is in line with the front most garage wall. The resident of Leyfield House is suitably concerned over this aspect of this planning application. It would be remiss of the Parish Council not to comment on this possible cause of contention. The same clause of the deeds ,which it is assumed are the same as those relating to the applicant’s property (as the two properties were built by same builder at the same time) also states that no building or other structure shall be erected ‘in front of the present face of the dwellinghouse’. It is the view of the Parish Council that the proposed conservatory would be in breach of that clause if that is what is stated in the deeds of the applicant’s house.
